The teachings of Jesus are not legal codes. He keeps distant from human government. The teachings are for spiritual development of believers, and they are centrally concerned with the cultivation of love (cf. John 13:34).
A thief, or a person thieving, is not showing love to others, and if Christians are in proximity to this person they would try and show love to him so as to cultivate his love of others. The thief is asked to awaken to the inherent needs and worth of others.
Although psychopathy is a difficult matter, and can be detected even in children, the teachings are that every person is capable of love and can experience divine grace.
